01 — The Service

Thryvo AI is an AI-powered social media marketing automation service operated by ThryvoAI LLC, a Vermont limited liability company. We provide small businesses with a dedicated AI marketing team — accessible via Telegram — that creates content, schedules posts, manages community engagement, and delivers weekly performance reports.

Your AI assistant is called VEXA. She is powered by artificial intelligence and acts as the primary interface between you and your AI marketing team.

02 — Your Account

To use Thryvo AI you must be at least 18 years old and have a valid Telegram account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You agree to provide accurate information during onboarding. False information may result in termination of your account.

03 — Plans and Billing

Plans

• Starter — $497/month
• Growth — $997/month
• Premium — $1,497/month
• Elite — $2,497/month

Free Trial

All plans include a 30-day free trial. No credit card is required to start. If you cancel before day 31 you owe nothing. Zero.

Billing

After your free trial, your chosen plan is billed monthly through Stripe. Annual billing is available at a discounted rate. You authorise us to charge your payment method on a recurring basis until you cancel.

Annual Billing

Annual plans are billed upfront for 12 months. If you cancel an annual plan early we will prorate a refund for unused complete months.

04 — Cancellation and Refunds

You can cancel at any time by messaging VEXA on Telegram. There are no cancellation fees and no contracts. Your service continues until the end of your current billing period.

Monthly plans are non-refundable after payment. If you have a billing issue or dispute please contact us before initiating a chargeback — we will resolve it directly and promptly.

If you experience a technical failure on our end that prevents your service from functioning for more than 72 consecutive hours we will credit your account for the affected days.

05 — What We Deliver

We will make reasonable commercial efforts to deliver the services described in your plan. Specific deliverables — posts per month, platforms covered, video creation — are described on our pricing page and may be updated with notice.

We do not guarantee specific follower counts, engagement rates, or sales results. Social media performance depends on many factors outside our control including platform algorithms, market conditions, and product demand.

All content created by your AI team remains subject to your approval before posting unless you have enabled auto-posting mode.

06 — Your Content

What you own — completely

Everything created for your brand belongs to you. This includes all AI-generated images, cinematic videos, captions, reports, product ideas, and your brand DNA file. We claim no ownership over any of it. You can take it, use it, publish it, or leave us at any time — it is yours.

Your original product photos, business information, brand materials, and any files you send us remain entirely your property at all times.

What we never do

• We never sell your data, your images, or your content to anyone — ever
• We never share your brand information, product photos, or business details with other clients
• We never use your specific content, product photos, or identifiable business information to train AI models
• We never name you publicly as a client without your explicit written permission

What we reserve the right to do

By using Thryvo AI you grant us a limited, non-exclusive licence to:

• Use anonymised, non-identifiable AI-generated content as examples of our work on our website and marketing materials — only where your business cannot be identified from the content
• Reference general statistics about our client base (for example "serving 500+ makers") without identifying you specifically
• Display AI-generated sample images and videos that demonstrate our capabilities — never your actual product photos without explicit consent

If you would like your work featured on our website, social media, or marketing materials with your name and brand attached, we will always ask for your explicit written permission first and you can say no.

AI training

We do not use your product photos, brand DNA, content, or any identifiable information to train AI models — ours or anyone else's. Your creative work is yours. We are here to amplify it, not to learn from it without your knowledge.

You are responsible for ensuring that content you provide to us does not infringe third-party intellectual property rights.

07 — Acceptable Use

You agree not to use Thryvo AI to:

• Create or publish content that is illegal, defamatory, harassing, or fraudulent
• Violate the terms of service of any social media platform we post to on your behalf
• Promote illegal products or services
• Impersonate any person or entity
• Attempt to access other clients' data or systems
• Reverse engineer or attempt to extract our AI systems or proprietary processes

Violation of these terms may result in immediate termination of your account without refund.

08 — Social Media Access

To post content on your behalf, we require OAuth posting permissions for your connected social media accounts. We use Buffer as our publishing platform — a service trusted by over 140,000 businesses worldwide.

Our access is limited to scheduling and publishing approved content. We cannot and will not access private messages on unsupported platforms, change your account settings, or delete your posts.

You can revoke our access at any time by removing Thryvo AI from your connected apps in each platform's settings. Revoking access stops all posting immediately.

09 — Limitation of Liability

To the maximum extent permitted by law, ThryvoAI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity, arising from your use of the service.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim.

10 — Disclaimers

Thryvo AI is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

We are not responsible for the actions of third-party platforms including but not limited to Instagram, TikTok, Facebook, Pinterest, and YouTube. Platform policy changes, algorithm changes, or account restrictions are outside our control.

11 — Governing Law

These terms are governed by the laws of the State of Vermont, United States. Any disputes arising from these terms shall be resolved in the courts of Vermont, and you consent to the personal jurisdiction of those courts.

12 — Changes to These Terms

We may update these terms from time to time. If we make material changes we will notify you through your VEXA bot on Telegram at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the new terms.
